Although the Central Election Commission validated the election results, three CEC members - Michael Buşuleac Vasile Gafton, Nicholas Gârbu - an explanatory note signed by the Constitutional Court stating several violations of electoral legislation.

We, members of the Central Election Commission, Michael Buşuleac Vasile Gârbu Gafton and Nicholas, have signed the process - the Central Election Commission report on the aggregation of legislative elections the Moldovan parliament XVII of April 5, 2009 with certain reservations which are the following:

1. While summarizing the figures arising from the minutes prepared by lower electoral bodies have a reservation on the correctness of these figures are as follows:
a) the electoral lists were drawn up by local governments with serious violations of electoral legislation. Many come on it is incorrect to draw up electoral lists Central Election Commission who presented the beginning of the electoral district councils CD secretaries who were included personal data Moldovan citizens received from the Ministry of Information Technologies under which the lists have been prepared and election.
b) subsequently proved that this CD contains erroneous data such as:
- Were included in voter lists deceased persons 15-20 years ago;
- The electoral lists were not included people who actually lived and do not live at the addresses indicated in these lists;
2. Complaints input provided to the Central Election Commission also confirmed that owners of buildings that is fraud and has asked the Central Electoral Commission came to voting that saw that the electoral lists have been included indicating the address of the person who owned real estate as a property, which does not have consented to completing the visa and reşidinţă home.
3. Above objective doubts are confirmed by the fact that the electoral Moldovan Communist Party on April 11 attacked the Chisinau Court of Appeal decision nr.2501 Central Election Commission of 8 April 2009 which allowed access to electoral candidates with the possibility of obtaining copies of those lists.
4. On 4 and 5 April broadcaster "I TV" which has national coverage, bad faith breach of art. 47 alin.14 electoral code were intentionally improper campaigning in favor of candidates, defavorizând other candidates.
5. During the electoral campaign of the Communist Party of Moldova uitilizat within administrative resources, which influence the elections.
